Starting May 26, 2025, the China National Intellectual Property Administration (CNIPA) will enforce stricter evidence requirements for filing 3-year non-use trademark cancellations.
What’s changing?
Applicants must now present substantial, verifiable proof of non-use, such as:
- Screenshots from at least three independent sources
- Market research data or industry reports
- Affidavits or notarized statements
Why this matters:
- Prevents abusive or speculative filings
- Encourages genuine market participation
- Demands thorough due diligence before challenging a mark
This move aligns with China’s push for more credible and fair trademark enforcement, protecting both brand owners and the integrity of the marketplace.
