Under the Intellectual Property Law 2022 (as amended 2025), layout designs of semiconductor integrated circuits are now recognized as protected industrial property objects — marking a significant milestone for the nation’s high-tech sector.
To be eligible for protection, designs must be:
✅ Original – not widely known among creators at the time of creation.
✅ Commercially new – not commercially exploited anywhere in the world before filing.
Legal references include Articles 68–75 of the IP Law (Amended 2022), Decree No. 65/2023/NĐ-CP, and Circular 23/2024/TT-BKHCN, which detail registration procedures and protection terms.
This enhancement is vital for innovation, technology transfer, and investor confidence, ensuring chip creators can protect their unique layout designs and prevent reverse engineering.
