With the final deadlines passing on March 1, 2026, for incomplete applications and June 1, 2026, for published marks, the DoI has shifted its focus from administrative file reconstruction to strict enforcement.

The Current Landscape: Understanding the Enforcement Phase

Because the file reconstruction windows have concluded, any pending trademark asset that was not manually resubmitted now faces immediate regulatory risk:

• The Seven-Year Cancellation Trigger: Applications that remained pending for more than seven years without a successful file reconstruction are now subject to automatic deletion from the official registry records without further administrative notice.
• Certificate Forfeiture Risks: For marks that successfully cleared the Industrial Property Bulletin publication stage without opposition, missing the June 1st cutoff means the opportunity for automated certificate issuance has closed, risking total application abandonment.
• The Priority Date Vulnerability: If a file was not reconstructed in time, the original priority date may be entirely lost, leaving core brand assets heavily vulnerable to localized trademark “squatting” by regional competitors.
