In the world of innovation, “waiting and seeing” is no longer a strategy. As of late 2025, the U.S. Patent and Trademark Office (USPTO) launched the Artificial Intelligence Search Automated Pilot (ASAP!). This initiative empowers inventors to receive an automated AI search report before formal examination even begins.
Early Intelligence, Smarter Decisions
The centerpiece of this program is the Automated Search Results Notice (ASRN). This report lists up to 10 highly relevant documents ranked by AI relevance—delivered months before a human examiner even opens the file.
| Feature | Traditional Process | ASAP! Pilot (2025/2026) |
| Search Timing | At start of examination | Pre-examination (within months) |
| Search Intelligence | Examiner-only until Office Action | AI-powered results shared with applicant |
| Cost Control | Non-refundable | ~38% refund if abandoned early |
| Response Options | Mandatory response to Office Action | Voluntary amendment or deferral |
The Specialist Vision: Strategic Refinement
“Your brand is never yours until you claim it.” The ASAP! program allows you to claim it more precisely. If the AI identifies “prior art” that threatens your application, you have the specialist vision to:
- Amend Early: Refine your claims to differentiate from the AI’s findings before the examiner sees them.
- Defer for Depth: Request to defer examination for up to three years to further evaluate the market.
- Recover Costs: If the AI reveals a high risk of failure, you can abandon the application and recover approximately 38% of your search and excess claim fees.
A Limited Window for Action
This is a first-come, first-served opportunity. The pilot is capped at 1,600 total applications (roughly 200 per Technology Center). Eligibility is restricted to original utility applications filed before April 20, 2026.
