In a blow to Crocs, the EU Court upheld a 2016 decision by the European Union’s Intellectual Property Office (EUIPO) to cancel their design protection for the iconic Crocs shoe.
Despite debuting in 2002, Crocs only sought design protection in 2004, but in the EU (and Australia), designs that are already released to the public can’t be protected.
This case serves as a sharp reminder to designers: always secure protection before your product hits the market.
