Formally launched on April 6, 2026, during the 78th ASEAN Working Group on Intellectual Property Cooperation (AWGIPC) meeting, the ASEAN Patent Examination Co-operation Plus (ASPEC+) programme marks a major upgrade in regional patent work-sharing. Announced on behalf of Indonesia’s Minister of Law, H.E. Mr. Supratman Andi Agtas, following foundational work led by the ASEAN Patents Task Force under Singapore’s chairmanship, ASPEC+ enables participating Member State IP offices to collaborate directly on regional patent reports and examination guidelines.
Unlike the standard sequential ASPEC modelβwhere applicants use an examination report from one office to accelerate prosecution in anotherβASPEC+ introduces a collaborative, parallel examination framework. Applicants can now designate multiple participating ASEAN Member State (AMS) IP offices (including Brunei, Cambodia, Indonesia, Lao PDR, Malaysia, the Philippines, Singapore, Thailand, and Viet Nam) to perform coordinated search and examination workflows simultaneously.
Key Highlights & Strategic Impact
The introduction of ASPEC+ transforms cross-border patent prosecution across ASEAN:
- 1. Collaborative Parallel Examination Model: Designated AMS IP offices share search results, prior art findings, and examination insights dynamically during the examination cycle to reach harmonized results.
- 2. Fast & Committed First Office Action Timelines: Under ASPEC+, applicants receive their first office actions from chosen AMS offices within a target window of 10 to 14 months from formality completion, providing rapid commercial certainty across target markets.
- 3. Harmonized Regional Examination Quality: Deepened collaboration between regional examiners promotes consistent prior art evaluation and claim interpretation across participating IP offices.
- 4. Optimized Prosecution Resources: Receiving identical or closely aligned examination results allows applicants to prepare synchronized office action responses, drastically reducing global legal expenses.
Recommended Prosecution Actions for ASEAN Applicants
To maximize the commercial benefits of the ASPEC+ initiative:
- Submit Simultaneous ASPEC+ Requests: File the ASPEC+ request form simultaneously across your chosen AMS IP offices alongside a comprehensive Claim Correspondence Table.
- Harmonize Claim Specifications Early: Ensure claim sets are aligned across national applications prior to requesting ASPEC+ processing to ensure full claim correspondence between designated offices.
- Fulfill Local Address-for-Service Rules: Engage registered local patent representatives in each designated ASEAN jurisdiction to ensure compliance with national filing rules.
- Integrate ASPEC+ into Regional Commercial Strategy: Leverage the 10β14 month first office action timeline to secure early, predictable patent rights prior to launching products across key ASEAN markets.
